Many divorcees will tell you that the single biggest mistake they made in their divorce was to use the family lawyer that had been serving the family faithfully for years or to simply go along with a proposal to use the same lawyer, who is more often than not a lawyer that the other party has instructed and consulted prior to the negotiations and settlement of the case.
There is a myriad of reasons why this is probably the single worst idea and the single most prejudicial thing that you can do in terms of conducting your divorce. There is nothing more important in terms of choosing the right lawyer for your divorce then finding a skilled and experienced attorney who knows nothing about you, your family or your spouse and whose only interest in the case is to represent you to the very best of his ability and to bring to bare for your benefit all of his knowledge, experience and expertise.
Now I’m not suggesting that you go out and find the most aggressive attorney in town or an attorney who will literally bury your spouse under the sheer weight of paperwork, generated in the course of litigating your divorce. To the contrary, this approach will do nothing more than cost you a lot of unnecessary money and almost without exception constitutes a barrier to the effective finalisation of your divorce.
On this note, a word of caution- do not canvas opinions on Facebook as to which local attorney is the best divorce lawyer in town. The references and opinions you will inevitably get is based on very little experience with any given attorney and will usually represent little more then the gratitude of a client for a professional service received to his satisfaction.
If you are going to go online and find a lawyer using a search engine such as Google, be sure to scrutinise the search results concerned for any signs of undercover marketing, undisclosed interest or other prejudices in favour of the said firm. Look for a lawyer who has positive reviews but not glowing praises which seem to be couched in similar language, which would be a clear sign that what you are reading is in fact marketing material written by a copywriter.
Remember, heading straight for the biggest law firm does not guarantee that you will have an attorney who is going to provide you with the best skills or knowledge.
Some of the best divorce lawyers that I have come across practice in small partnerships or even as sole practitioners.
